These Terms and Conditions define the rights and obligations of the User and the Seller in connection with the use of this Website and the conclusion of sales contracts via the Service. Before placing an Order, the User is required to read these Terms and Conditions.

§ 1. Definitions

  1. System Administrator - the Seller or another entity designated by the Seller to manage the Website or Service.
  2. Consumer - a User who is a natural person making a purchase unrelated directly to their business or professional activity.
  3. Entrepreneur with Consumer Rights - a natural person running a sole proprietorship making a purchase that is not of a professional nature for them.
  4. Order Costs - costs associated with preparing and delivering the Product, in particular packaging and shipping costs.
  5. Amount Due - the sum of the Product price and Order Costs.
  6. Privacy Policy - the set of rules for processing and protecting personal data of Users, available on the Website.
  7. Product - movable goods presented on the Website that may be the subject of an Order.
  8. Refund - the return of Order Costs or the Product price, described in detail in § 6 of these Terms and Conditions.
  9. Terms and Conditions - this document in its entirety.
  10. Service - the online service through which the User places Orders.
  11. Seller - „CHABIN" limited partnership (spółka komandytowa) with its registered office in Łódź, ul. Praska 31, 93-181 Łódź, Poland, entered in the National Court Register under KRS no. 0001049308, District Court for Łódź-Śródmieście in Łódź, 20th Commercial Division of the National Court Register, NIP: 727-243-66-37, REGON: 47222732, e-mail: esklep@chabin.pl, phone: +48 42 684 98 72.
  12. Website - the website available at chabin.pl, owned by the Seller.
  13. User - a person visiting the Website, including a person placing an Order and making a purchase via the Service.
  14. Manufacturer - the entity producing or making the Product.
  15. Order - the User's offer to purchase a Product, specifying its type and quantity, placed via the Service.

§ 2. General Terms of Use of the Service

  1. A User placing an Order must be at least 18 years old and have full legal capacity. A person who has reached the age of 13 may place an Order only with the prior consent of their legal guardian.
  2. All information published on the Website, in particular commercial information, price lists and advertisements, constitutes an invitation to submit offers to conclude a distance sales contract and does not constitute an offer within the meaning of the Civil Code.
  3. Placing an Order by the User is equivalent to submitting an offer to conclude a distance sales contract. A condition for placing an Order is acceptance of these Terms and Conditions and the Privacy Policy by ticking the appropriate box in the Order form.
  4. All prices shown on the Website include taxes applicable at the Seller's registered office. The User is responsible for determining what other taxes or charges (e.g. customs duty, excise duty, VAT) apply at the place of delivery of the Product.
  5. Product prices do not include taxes and charges applicable to delivery destinations other than the territory of Poland. In clearly indicated cases, the Product price may include the shipping cost.
  6. The Seller reserves the right to change Product prices, introduce new Products, withdraw Products and run or cancel promotional campaigns - without prior notice to Users, subject to § 3 para. 18 of these Terms and Conditions.
  7. All Products covered by an Order are new, factory-sealed and comply with the legal requirements applicable in Poland. Before placing an Order, the User is required to familiarise themselves with the law applicable at the place of delivery of the Product.
  8. Colours and finishes of Products shown on the Website may differ from the actual appearance due to photographic technologies used. Manufacturers reserve the right to make technical changes to Products without prior notification to the Seller.
  9. Product images are for illustrative purposes only. The Seller is not liable for differences between the appearance of a Product on the Website and its actual appearance.
  10. The Seller is not liable for damage caused by improper use of the Product.
  11. Users may contact the Seller by e-mail or telephone, using the contact details provided on the Website.
  12. The Website and its content are protected by copyright. Copying, collecting or using information published on the Website without the Seller's consent is prohibited.

§ 3. Sale of Products and Order Fulfilment

  1. Users may place Orders 24 hours a day, 7 days a week via the Service. Clicking the "Pay", "Buy" or "Order with obligation to pay" button creates an obligation to pay the Amount Due.
  2. Orders placed on business days after 12:00 noon, as well as on Saturdays, Sundays and public holidays, will be processed on the next business day.
  3. The Seller may refuse to fulfil an Order without stating a reason.
  4. Orders placed are verified by the Seller.
  5. The User receives an e-mail confirming all key details of the Order and its acceptance by the Seller.
  6. Upon confirmation of Order acceptance, a distance sales contract is concluded. At the User's request, the Seller will issue a VAT invoice and send it to the e-mail address provided, after payment has been credited.
  7. To place an Order, the User must provide correct personal data: first and last name or company name, delivery address and e-mail address. Providing a phone number is optional.
  8. The Seller reserves the right to verify the data provided by the User. If verification is not possible, the Seller may cancel the Order.
  9. The User may choose the payment method:
    1. prepayment - bank transfer or electronic payment via a system indicated in the Service,
    2. cash on delivery - available only in cases clearly indicated on the Website, subject to an additional fee disclosed before the Order is placed.
  10. In the case of prepayment, the Product is dispatched after 100% of the Amount Due has been credited to the Seller's bank account.
  11. In the case of cash on delivery, payment is made in cash to the courier upon delivery. The Product remains the property of the Seller until the full Amount Due has been paid.
  12. Payments may be processed by a third party acting on behalf of the Seller. The User is required to read the terms and conditions of that third party. The Seller is not liable for delays caused by the payment operator.
  13. The User may choose delivery via postal operator or courier company, or collect the Order in person at the Seller's registered office at an agreed time.
  14. Order fulfilment time is up to 7 business days from the date of payment being credited (for prepayment) or from the date of Order confirmation (for cash on delivery).
  15. If a Product is out of stock, the fulfilment period runs from the date of restocking - the User will be informed of this in the Order confirmation.
  16. The Seller reserves the right to withdraw from the contract if a Product is out of stock during fulfilment, of which the User will be notified immediately. In such a case, the User bears no costs.
  17. The Seller is not liable for late delivery by the postal operator or courier company.
  18. The Amount Due confirmed at the time of Order acceptance is binding and does not change even if prices on the Website change subsequently.
  19. Refusal to accept delivery or failure to collect a parcel does not constitute withdrawal from the contract. In such a case, the User bears the cost of returning the Product to the Seller in accordance with the price list on the Website, payable within 7 business days of the refusal/failure to collect. Re-dispatch is possible only after the return costs have been settled and a prepayment for re-dispatch has been made. This provision does not affect the right of withdrawal under § 5 of these Terms and Conditions.

§ 4. Changing or Cancelling an Order

  1. The User may change or cancel an Order that has not yet been dispatched by the Seller.
  2. To change or cancel an Order, the User must contact the Seller by e-mail or telephone, providing: first and last name, Order number and e-mail address, and in the case of a change - the scope of that change as well.
  3. A change or cancellation of an Order requires confirmation by the Seller.
  4. The details provided in the change or cancellation request must match the details provided when placing the Order. Failure to meet this requirement renders the request ineffective.
  5. This paragraph does not affect the User's right of withdrawal under § 5 of these Terms and Conditions.

§ 5. Right of Withdrawal

  1. A User who is a Consumer or Entrepreneur with Consumer Rights and who has concluded a distance sales contract may withdraw from the contract within 14 calendar days without giving any reason and without incurring any costs other than the direct costs of returning the Product.
  2. The withdrawal period runs from the day on which the User took physical possession of the Product, or on which a third party designated by the User (other than the carrier) took physical possession of the Product.
  3. To exercise the right of withdrawal, the User submits an unambiguous statement to the Seller - by post to the Seller's registered address or by e-mail to esklep@chabin.pl. The User may use the model withdrawal form below, but this is not mandatory.
  4. The withdrawal deadline is met if the User sends the statement before it expires. Upon receipt of the statement, the Seller immediately confirms receipt by e-mail.
  5. In the event of withdrawal, the Seller refunds all payments received from the User, including Order Costs (except for additional costs resulting from the User's choice of a delivery method other than the cheapest standard method offered by the Seller), without undue delay and in any event no later than 14 days from the date of receipt of the withdrawal statement. The refund is made using the same payment method used by the User, unless the User expressly agrees to a different method. The User does not bear any charges in connection with the refund.
  6. The Seller may withhold the refund until the Product has been received or until the User has provided proof of its return, whichever occurs first.
  7. The User is required to return or hand over the Product to the Seller without undue delay and in any event no later than 14 days from the date of withdrawal.
  8. The User bears the direct costs of returning the Product.
  9. The User is liable for any diminished value of the Product resulting from handling it in a way other than necessary to establish its nature, characteristics and functioning.

§ 6. Complaints and Product Returns

  1. The Seller is obliged to deliver Products that conform to the contract and are free from defects. In the event of defects, the Seller bears statutory liability under the warranty provisions of Articles 556 et seq. of the Civil Code and the Consumer Rights Act.
  2. Complaints may be submitted in respect of Products that do not conform to the contract and parcels damaged in transit. Complaints relating to mechanical damage caused by the User will not be accepted.
  3. A complaint submission should include: Order number, first and last name (or company name), e-mail address, postal address, phone number, description of the complaint and the User's position. The User's bank account number for a potential Refund will be requested after the complaint has been resolved in the User's favour.
  4. Complaints should be submitted by e-mail to esklep@chabin.pl or by post to the Seller's registered address.
  5. The Product subject to a complaint must be sent promptly to the address indicated by the Seller. The fulfilment period for the complaint begins upon receipt of the Product.
  6. The User is required to pack the returned Product in a way that prevents damage in transit.
  7. The Seller will process the complaint and provide a response within 14 calendar days of receipt of the submission. Failure to respond within this period constitutes acceptance of the complaint. The response is sent to the e-mail or postal address provided by the User.
  8. In the event of a Refund, the Seller transfers an amount equal to the purchase price of the Product to the bank account provided by the User.
  9. The User is required to inspect the parcel upon delivery. If damage is found, a damage report signed by the User and the delivery person should be drawn up - this serves as the basis for a complaint regarding damage in transit.
  10. The Seller does not provide a warranty on Products sold via the Service. Warranties on individual Products are provided by their Manufacturers - details are set out in the warranty document.
  11. Initiating a chargeback procedure by the User in the case of payment by credit or debit card results in suspension of the complaints procedure until the dispute is resolved.

§ 7. Out-of-Court Dispute Resolution

  1. A User who is a Consumer has the right to use out-of-court methods of complaint resolution and redress, in particular:
    • mediation conducted by the relevant Regional Inspectorate of the Trade Inspection Authority (Inspekcja Handlowa),
    • a permanent consumer arbitration court at the relevant Regional Inspectorate of the Trade Inspection Authority,
    • assistance from a district or municipal consumer ombudsman.
  2. Detailed information on out-of-court complaint resolution methods is available on the website of the Office of Competition and Consumer Protection (UOKiK): www.uokik.gov.pl.
  3. A User who is a Consumer may use the EU online dispute resolution (ODR) platform available at: ec.europa.eu/consumers/odr. The Seller's e-mail address for ODR purposes: esklep@chabin.pl.
  4. Use of out-of-court dispute resolution methods is voluntary and requires the consent of both parties.

§ 8. Final Provisions

  1. These Terms and Conditions form an integral part of the sales contract.
  2. After a contract has been concluded, any amendment to these Terms and Conditions that affects that contract may only be made with the prior consent of both parties.
  3. The System Administrator is entitled to unilaterally amend these Terms and Conditions by publishing the new version on the Website. Amendments take effect only in respect of Orders placed after their introduction.
  4. The Seller processes the User's personal data to the extent necessary to fulfil the Order. Detailed rules are set out in the Privacy Policy available on the Website.
  5. If any provision of these Terms and Conditions is found to be invalid or ineffective, this does not affect the validity of the remaining provisions.
  6. Disputes between the User and the Seller will be resolved first through amicable negotiations.
  7. For Users who are not Consumers or Entrepreneurs with Consumer Rights, the court with jurisdiction over the Seller's registered office shall be competent to resolve disputes. For Consumers and Entrepreneurs with Consumer Rights, jurisdiction is determined in accordance with the Code of Civil Procedure.
  8. Matters not regulated by these Terms and Conditions are governed by Polish law, in particular the Civil Code and the Act of 30 May 2014 on Consumer Rights.
